Terms of Service

1. Acceptance of terms

By downloading, installing, or using the Eurth mobile application or website at eurth.ca (collectively, the "Service"), you ("you" or "User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Eurth (Toronto, Ontario, Canada). By using the Service, you represent that you are at least 13 years of age.

2. Description of service

Eurth is a personal habit tracking application that allows users to log, track, and build consistency around their supplement and medication routines. The Service includes a supplement and medication stack builder, daily check-off and streak tracking, push notification reminders, barcode scanning, prescription label photography for medication name extraction, consistency insights and history, and optional Pro subscription features.

Eurth is a habit tracking tool, not a medical application. The Service does not provide medical advice, diagnose conditions, recommend treatments, or verify the accuracy or appropriateness of any supplement or medication. See Section 7 for the full medical disclaimer.

3. Accounts and registration

To access certain features, you must create an account using a valid email address and password. You agree to provide accurate information, maintain the security and confidentiality of your credentials, notify us immediately at hello@eurth.ca if you suspect unauthorized access, and accept responsibility for all activity under your account.

We reserve the right to suspend or terminate accounts that we believe have violated these Terms or engaged in fraudulent or abusive activity.

4. Subscriptions and billing

Free tier

Eurth offers a free tier that includes core supplement tracking functionality at no cost, available indefinitely without a payment method.

Eurth Pro

Eurth Pro is a premium subscription offering additional features including extended history, streak freeze, multiple profiles, custom reminders, and cohort-specific tools, available on a monthly or annual basis.

Billing

All subscription purchases are processed through the Apple App Store. Your Apple ID will be charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may manage and cancel your subscription in your Apple ID account settings at any time.

Refunds

All purchases are final and non-refundable except as required by applicable law or as determined by Apple's refund policies. To request a refund, contact Apple directly through the App Store.

Price changes

We reserve the right to change subscription pricing at any time with at least 30 days' notice before the change takes effect for existing subscribers.

5. Acceptable use

You agree not to use the Service to violate any applicable law, upload false or misleading content, attempt to gain unauthorized access to any part of the Service, reverse engineer or decompile the Service, use automated tools to scrape or extract data, interfere with the integrity or performance of the Service, or impersonate any person or entity. We reserve the right to suspend or terminate access for users who violate these Terms.

6. Prescription label scanning

By using the prescription label scanning feature, you acknowledge and agree to the following terms.

Purpose and limitations

The prescription label scanning feature uses optical character recognition (OCR) technology to extract text from photographs of medication labels or supplement bottles. This feature is provided as a convenience to help you add products to your personal tracking routine. It is not a clinical, pharmaceutical, or medical records tool.

Your responsibilities

You agree that you will only photograph prescription labels or medication bottles for which you are the named patient, caregiver, or authorized representative; you will review and verify all information extracted by the OCR feature before adding it to your stack; you will not rely on OCR-extracted information as a substitute for reading the original prescription label; and you will follow your healthcare provider's instructions regarding your medications.

Image handling

Prescription label images are transmitted securely to a third-party OCR provider for text extraction and are not stored by Eurth or its service providers after processing. No copy of your prescription image is retained. See our Privacy Policy for full details.

No medical interpretation

Eurth does not interpret, analyze, flag, or make any recommendation based on the content of your prescription label. The Service extracts text only. Any clinical decisions regarding your medications must be made in consultation with your healthcare provider.

Limitation of liability for scanning

To the maximum extent permitted by applicable law, Eurth shall not be liable for any errors, omissions, or inaccuracies in OCR-extracted information, or for any harm arising from your reliance on such information. You use the scanning feature at your own risk.

7. Medical disclaimer

Please read this section carefully. It significantly affects your legal rights.

Not medical advice

The Service is a personal habit tracking tool. Nothing in the Service — including supplement information, medication names, dosage fields, timing suggestions, guide content, or cohort-specific features — constitutes medical advice, clinical guidance, diagnosis, prognosis, or treatment recommendation.

No healthcare provider relationship

Use of the Service does not create a physician-patient, pharmacist-patient, or any other healthcare provider relationship between you and Eurth. Eurth is not a licensed healthcare provider and does not employ healthcare professionals to review your personal health data.

Drug interactions

Eurth does not check for drug interactions, contraindications, allergic reactions, or other safety considerations. You are solely responsible for consulting with a qualified healthcare professional regarding any potential interactions or safety concerns.

Consult your doctor

Always consult a qualified and licensed healthcare professional before starting, stopping, or changing any supplement, vitamin, or medication regimen. Do not delay seeking professional medical advice because of something you have read or tracked in Eurth.

Assumption of risk

By using the Service, you voluntarily assume all risks associated with your supplement and medication decisions. Eurth expressly disclaims all responsibility for any adverse health outcomes that may arise from your use of the Service.

8. Intellectual property

The Service, including all software, design, text, graphics, logos, and content created by Eurth, is owned by Eurth and protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of all personal data you enter into the Service. By using the Service, you grant Eurth a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service to you.

9. Disclaimers and warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE.

We do not warrant that the Service will be error-free, secure, or continuously available, or that any information provided through the Service — including supplement information, product names, or OCR-extracted data — is accurate, complete, or useful.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EURTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL EURTH'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO EURTH IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR CAD $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Eurth and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of any third-party rights, or any inaccurate information you submit through the Service.

12. Termination

You may terminate your account at any time by deleting it within the app or by contacting hello@eurth.ca. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms.

Sections 7, 8, 9, 10, 11, and 13 of these Terms shall survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

If you are a consumer in Canada, you may also have rights under applicable provincial consumer protection legislation that cannot be waived by contract.

14. Changes to terms

We may update these Terms at any time. When we make material changes, we will update the date above and provide in-app notice or email notification. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
